This website is operated by Vascend, trading as Vascend Pets. The terms "we", "us", and "our" refer to Vascend trading as Vascend Pets.

Vascend operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the "Services") to provide customers with a curated pet product shopping experience.

Vascend Pets is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.

By using the Services, you represent that you are at least the age of majority in your place of residence.

You are responsible for ensuring that any minor dependents who access the Services using devices you own or manage do so with your consent.

To use certain features of the Services, including placing an order, you may be required to provide information such as your email address, billing details, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

We make reasonable efforts to ensure product descriptions, images, and information are accurate. However, product appearance may vary due to manufacturing processes, printing methods, screen settings, or device differences.

We do not guarantee that appearance, color, or finish will exactly match what is displayed online.

All pet products sold through Vascend Pets are intended for use with animals under owner supervision. It is the responsibility of the customer to assess the suitability of any product for their specific animal, including species or breed, size, age, temperament, and health status.

We do not make veterinary or medical claims regarding any product. No product sold through Vascend Pets is intended to diagnose, treat, cure, or prevent any condition in animals. If your animal has a health condition, please consult a licensed veterinarian before introducing any new product.

Products are sold as described. Customers are responsible for following any care, safety, or usage instructions provided with the product or on the product page. We are not liable for injury, illness, or damage resulting from misuse, improper supervision, or use of a product in a manner inconsistent with its stated purpose.

Some products, including chews, toys with small parts, and certain accessories, may present a choking or safety hazard if used without supervision. Please review product descriptions and size guidance carefully before purchase.

 

Section 4 -- Orders

Placing an order constitutes an offer to purchase.

Vascend reserves the right to accept or decline any order at its discretion.

An order is not considered accepted until payment has been successfully processed and confirmation has been issued.

Purchases are subject to our Returns and Refunds Policy.

All purchases are intended for personal or household use only and not for commercial resale or export.

 

Section 5 -- Order Modifications and Cancellations

We begin processing orders promptly after they are placed. Once an order has entered fulfillment or dispatch, we may be unable to change or cancel it. If you need to change or cancel an order, please contact us as soon as possible at pets@vascend.com.au. We will make reasonable efforts to assist but cannot guarantee that changes or cancellations will be possible once processing has commenced.

 

Section 6 -- Stock Availability

Product availability is subject to change and inventory information from our fulfillment partners may occasionally be delayed or inaccurate. If an item becomes unavailable after an order is placed, we may cancel the affected item and issue a full refund for that item. Where appropriate, we may contact you first to offer a suitable alternative, but you are not required to accept a substitute.

 

Section 7 -- Prices, Billing, and Promotions

All prices are displayed in the currency shown at checkout.

Prices, discounts, and promotions are subject to change without notice.

Unless expressly stated, prices do not include taxes, shipping, customs duties, or import fees.

Free shipping eligibility and promotional discounts are calculated automatically at checkout and are subject to stated conditions.

You authorize us to charge your selected payment method for the full order amount.

 

Section 8 -- Shipping and Delivery

Shipping terms are outlined in our Shipping Policy.

Delivery timeframes are estimates only and not guaranteed.

We remain responsible for your order until it is delivered to you. If a shipment is lost or damaged in transit, please contact us and we will arrange a replacement or refund in accordance with our Shipping Policy. Nothing in this section limits your rights under the Australian Consumer Law.

 

Section 9 -- Intellectual Property

All content on the Services is owned by Vascend trading as Vascend Pets or its licensors and is protected by applicable intellectual property laws.

The Services are provided for personal, non-commercial use only.

We are not responsible for third-party websites linked through the Services. Accessing third-party sites is at your own risk.

This store is powered by Shopify. All sales are conducted between you and Vascend trading as Vascend Pets. Shopify is not responsible for transactions conducted through this store.

Personal information is governed by our Privacy Policy. Vascend acts as the data controller of personal information collected through the Services.

 

Section 14 -- Feedback

If you submit feedback or content, you grant Vascend a perpetual, royalty-free license to use that content.

To the fullest extent permitted by law, Vascend shall not be liable for indirect or consequential damages arising from use of the Services. Nothing limits rights under applicable consumer protection laws.

To the extent permitted by law, we exclude liability for harm, illness, injury, or death to any animal arising from misuse of a product, failure to follow supervision, safety, or usage instructions, or use inconsistent with the product's description and stated purpose. This exclusion does not apply where the harm results from a failure to comply with a consumer guarantee under the Australian Consumer Law, a defect in the product, or our negligence. Customers remain responsible for assessing the suitability of any product for their animal, including species or breed, size, age, temperament, and health status.

 

Section 20 -- Indemnification

You agree to indemnify and hold harmless Vascend from claims arising from your breach of these Terms.

 

Section 21 -- Force Majeure

Vascend shall not be liable for any delay or failure to perform its obligations where such delay or failure arises from causes beyond our reasonable control, including but not limited to natural disasters, pandemic, carrier disruption, supplier failure, government action, or internet service interruption. We will make reasonable efforts to resume normal operations as quickly as possible.

 

Section 22 -- Severability

If any provision is unenforceable, remaining provisions remain in effect.

 

Section 23 -- Entire Agreement

These Terms constitute the entire agreement between you and Vascend trading as Vascend Pets.

 

Section 24 -- Assignment

We may assign these Terms without notice.

 

Section 25 -- Governing Law

These Terms are governed by the laws of New South Wales, Australia.

 

Section 26 -- Dispute Resolution

If a dispute arises between you and Vascend in connection with these Terms or the Services, we encourage you to contact us first at pets@vascend.com.au to attempt an informal resolution. We will endeavor to respond within 5 business days.

If the dispute cannot be resolved informally, it will be subject to the jurisdiction of the courts of New South Wales, Australia, in accordance with Section 25 of these Terms.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

 

Section 27 -- Changes to Terms

We may update these Terms from time to time. Continued use constitutes acceptance.
